Context

The FIDIC Contracts Specialist will be responsible for overseeing all contractual and legal aspects of the Madinah BRT project. This role ensures that the project complies with the conditions of the FIDIC (International Federation of Consulting Engineers) contract, managing risks, claims, and contract administration. The specialist will work closely with project management, engineering teams, and stakeholders to ensure smooth contract execution and to mitigate disputes.

Missions/Main Duties

  • Contract Management:
    • Oversee all contractual matters on the project, ensuring compliance with FIDIC contracts (Red, Yellow, or Silver Books, as appropriate).
    • Manage contract lifecycle from award to closeout, including contract reviews, negotiations, and amendments.
    • Ensure proper documentation and reporting in line with FIDIC standards.
  • Claims and Dispute Resolution:
    • Handle contractor and client claims, identify potential issues, and suggest strategies for mitigation.
    • Manage dispute resolution processes, including arbitration or negotiation.
    • Ensure timely and accurate submission of claims, extensions of time, and variations.
  • Risk Management:
    • Assess contractual risks and develop strategies to mitigate them.
    • Advise project teams on FIDIC provisions and potential contractual impacts of project decisions.
    • Provide early warnings for potential risks or issues that could result in contractual disputes.
  • Coordination with Stakeholders:
    • Act as the primary point of contact for all contractual matters with contractors, consultants, and clients.
    • Liaise with legal teams, project managers, and financial departments to ensure smooth project execution.
    • Support in negotiations with external parties regarding contract changes or disputes.
  • Legal Compliance:
    • Ensure all contracts and related activities comply with local laws and regulations.
    • Advise on the implications of legal or contractual changes to the project.

Profile/Skills

  • Education:
    • Bachelor’s degree in Law, Engineering, Construction Management, or a related field.
    • Professional certification in FIDIC Contract Management is preferred.
  • Experience:
    • Minimum of 8 years of experience in contract management, with specific expertise in FIDIC contracts.
    • Prior experience on large-scale infrastructure projects, especially in the transportation or BRT sector, is preferred.
    • Experience working in the Middle East or GCC countries is highly desirable.
  • Skills:
    • In-depth knowledge of FIDIC contract forms, particularly Red and Yellow Books.
    • Excellent negotiation, communication, and dispute resolution skills.
    • Strong analytical abilities to assess contract risks and develop mitigation strategies.
    • Proficiency in contract management software and MS Office.
