Contract and Claim Engineer – Schneider Electric
Job Description:
- Meet and negotiate with customer counterparts defending Contractor contractual position.
- Draft letters correspondence response to customer contractual letters.
- Pro-actively draft letters correspondences to customer documenting delays, cost impact etc emanating from customer side.
- Liaise with project key team members to keep pulse of project progress and issues faced.
- Draft and negotiate subcontracts for sub-contractors and sub-vendors to make sub-contracts with true flow down of Terms & Conditions
- Review final contract against agreed and approved position
- Perform a contract summary with key contractual rights / obligation aspects.
- Support project manager on risk and opportunity identification and management.
- Identify, prepare, submit, and negotiate variation orders and claims with both customer and subcontractors in a timely and effective manner.
- Participate in project reviews, propose and support mitigation actions as required.
- Ensure local tax, bonding, insurance & customs issues are identified and addressed.
- Assisting the project manager in the cost and value reconciliation of the project with particular focus on variation/ claim forecasting.
- Coach the team members on all contract management related matters.
- Drive a culture to improve identifying, controlling and mitigating key contract risks;
- Deploy corporate tools, templates, processes, systems, and guidelines.
- The Potential candidate, without supervision, proactively co-ordinates with all stakeholders, gathers data and compiles variation requests/proposals for approval in compliance with the relevant contract terms.
- To critically analyze and interpret the contractual clauses and provisions in the interest of project and Contractor.
- Preparation of claims and presentation to client by collating related information and furnish analysis based on facts and documented records.
- To contractually safeguard Contractor’s interest by implementing global best practices of the profile.
- Participate or organize internal meetings and meetings with external contract partners
Education:
University and/or business school and/or engineer diploma: Master’s degree or equivalent BAC+5, business administration, international trade and/or law
Diploma, certification or equivalent in contract management
Experience:
Minimum 10 years of experience working in EPC / end user environment preferably for Control System / Cyber security side of projects.
Skillset:
- Fluent in English language (written and spoken)
- Hands on experience of drafting contractual letters
- Hands on experience of drafting and negotiating subcontracts for subcontractors with flow down of contract terms of conditions.
- Leadership and Communication skills to lead discussion with end user and EPC team member to achieve targets.
- General understanding of engineering, procurement, construction techniques EPCM & LSTK Professional membership/certification such as CIArb, SCL, FIDIC, CCM, RICS etc. from globally recognized institutions.
